Judge Dismisses Lawsuit Against Sigma Drilling Technologies, LLC

News Provided By Macdonald Devin, P.C.

DALLAS, May 15, 2019 /PRNewswire/ -- The honorable Judge Amos L. Mazzant, III of The U.S. District Court for the Eastern District of Texas, Sherman Division signed an order on May 9, 2019, dismissing all claims in a case filed by Performance Pulsation Control, Inc. (PPC) against multiple defendants, including Sigma Drilling Technologies, LLC.  No defendant paid any money or other consideration in settlement of any claim.

Performance Pulsation Control, Inc. initially filed a State action in Collin County on June 29, 2016.  The federal lawsuit was filed a year later on June 27, 2017.  On March 11, 2019, Judge Mazzant dismissed several claims against the Defendants and entirely dismissed Sigma's distributor from the case on summary judgment.  With 385 filings on the Court's docket and trial scheduled to begin on May 20, 2019, PPC's owner, John Rogers, wrote a letter to Judge Mazzant requesting permission to dismiss the case, citing religion as the impetus.

"Far be it from me to question a man's faith, but a cynical man might interpret a press release trumpeting one's own generosity as a little self-serving.  I am reminded of Proverbs:

Let another praise you, and not your own mouth; someone else, and not your own lips. (Proverbs 27:2, NIV)

"We believe that the lack of any evidence against our clients and the permanent injunction entered against Mr. Rogers in a theft of proprietary information case coming to light might have had something to do with the timing.  (Cause No. 96-8418-J in the 191st Judicial District Court of Dallas County, Texas). We are happy to have won the case, but disappointed that we will not be able to expose the allegations for what they were in open court.  That said, we are happy to turn the other cheek and wish PPC luck in their future endeavors," said attorney Greg Ziegler of Dallas-based Macdonald Devin P.C.

The case is Performance Pulsation Control, Inc. v Sigma Drilling Technologies, LLC, Intrepid Consulting, LLC, Justin Manley, Alison Manley, William Garfield, and Pamela Goehring-Garfield – CASE NO. 4:17cv450 – Filled in the US Eastern District of Texas, Sherman Division.
